Before using and/or placing an order through this Website or the Mobile Application, we ask that you carefully read our Terms and Conditions, our Privacy Policy, our Shipping Policy, and our Returns and Exchanges Policy.

ACCEPTANCE

Welcome to the HEREA website (the “Site”), owned by the legal entity HEREA RETAIL, S.A. DE C.V. (hereinafter, collectively, “we” and/or “HEREA”). The protection of your privacy is of utmost importance to us. This Privacy Policy (the “Policy”) describes the manner in which your personal data is collected, processed, used, and disclosed by HEREA, in accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties, as well as other applicable and current regulatory provisions in Mexico.

The use of this Site, as well as the use of the HEREA mobile application on your smartphone and/or portable device (the “Mobile Application”), is voluntary. By accessing and using the Site and/or the Mobile Application, you grant your consent for the collection and use of your identifiable and non-identifiable information in accordance with the provisions of this Policy.

Likewise, you agree that all terms of this Privacy Policy are also applicable when you interact with us through social media, email, and/or by telephone, as well as when you participate in contests or promotions organized by HEREA. You also agree that the terms of this Privacy Policy shall apply to any person who has participated through a third party via the “Tag a friend” dynamic or similar, on any social media platform."

PURPOSE

This Policy is intended to inform you of the manner in which personal data is collected, used, stored, protected, and, where applicable, shared because of the use of the Site and/or the Mobile Application. It also establishes the principles, rights, and obligations in accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties, as well as other applicable and current regulatory provisions in Mexico.

Through this Policy, you acknowledge, accept, and confirm that the use of the Site and/or the Mobile Application implies full and unconditional acceptance of this Policy.

MINORS

HEREA does not offer or market products directed at minors; therefore, you acknowledge and accept that if you are under 18 years of age, you are not authorized to use the “Site” and/or “Mobile Application,” nor do you have any capacity to provide personal information, including, but not limited to, your name, address, email address, and/or username used.

You acknowledge and accept that HEREA does not intend to collect personal information from minors; therefore, in the event that your child has provided personal data and you wish to request its deletion, you may contact us through the means indicated on the “Site” and/or “Mobile Application,” whereby HEREA will promptly address your request, delete such information, and refrain from using and/or retaining it in our databases.

INFORMATION WE COLLECT

You acknowledge and accept that HEREA will collect the following information:

A. Contact details, such as name, address and/or email address, telephone number and/or any other contact number;
B. Username and the password created to access the Site;
C. Information related to purchases and banking transactions, as well as your bank card details (credit and/or debit);
D. Photographs, videos, audiovisual material, multimedia content, comments, and any type of content that you provide on the “Site” and/or on social media.
E. Information you provide about third parties, such as acquaintances, family members and/or friends, product recipients or any third party on the “Site” and/or on social media;
F. Information from social media accounts, such as username, profile picture, comments, contacts, photographs, videos, audiovisual material, multimedia content, comments, and any other type of information and/or content derived therefrom;
G. Information related to customer service and technical support, such as inquiries, comments, incident data, and information regarding returns;
H. Payment card data or other related information, such as card number, expiration date, authorization/security code, billing information, and any type of information related to the payment methods used on the “Site,” which are collected and stored through external payment service providers.

Regardless of the above, it is important to note and state that your credit and/or debit card information is encrypted and will be sent to the corresponding issuer for verification and approval, such that HEREA will not retain said information once the verification and payment process is completed. Only if you so choose, you may save your bank card details (credit and/or debit) for future purchases; such information will be stored by the payment processor, not on the “Site.”

In the event that you do not provide the personal information that is reasonably required, we may not be able to provide you with the requested services and/or information and/or data."

COLLECTION OF YOUR INFORMATION

"You accept and acknowledge that the collection of personal data by HEREA occurs as a result of your interaction with the Site and/or Mobile Application, as well as through the use of services made available to you by HEREA. Below are the specific instances in which such collection may take place:

A. Information provided by you

We collect information directly from you when:
1) You register online on our “Site” and/or on the Mobile Application;
2) You make product purchases through the “Site” and/or the Mobile Application;
3) You subscribe to our newsletter or request to receive promotional communications;
4) You request to be notified when an item becomes available again;
5) You participate in promotions, surveys, rewards programs, or other initiatives;
6) You submit comments, reviews, or other user-generated content;
7) You interact with us through social media; and/or
8) You request customer support, including but not limited to the use of the “Contact Us” features available on our “Site” and/or Mobile Application.

B. Information collected automatically

We automatically collect electronic information related to your browsing when you visit our “Site” and/or Mobile Application, such as IP address, browsing history, and interactions with the website. We also collect geolocation data. This information may be obtained through the use of browser cookies and other tracking technologies. C. Payment information

If you make a purchase through our “Site” or “Mobile Application,” we will collect the bank card data (credit and/or debit) used to make the payment, such as name, expiration date, authentication code, and billing address, as well as any other data necessary for the payment to be processed. This information will be transmitted to the corresponding external payment service providers, in accordance with the provisions of Article 35 of the Federal Law on the Protection of Personal Data Held by Private Parties. Additionally, we may offer you the option to save certain credit and/or debit card data on our “Site” and/or Mobile Application. If you choose to enable this feature, you may add, delete, or modify such information at any time from your account settings.

D. Social Media

You agree that by interacting with us through social media platforms such as Instagram®, Facebook®, and/or “X”®, as well as any other existing or future social media platform, through actions such as “likes,” “reposts,” comments, “threads,” “templates,” and any other type of existing or future interaction, and also by using features such as plugins, widgets, social media login, or other tools provided by such platforms—such as Facebook Connect® or any other existing or future tool—we may collect the information you share with us (including, but not limited to: name, user profile, age, preferences, choices, photographs, images, videos, sounds, audiovisual material, and multimedia content) or any information shared with us from those social media platforms.

USE OF YOUR INFORMATION

You acknowledge and accept that we use your personal information for the purposes established in this Privacy Policy, which include:

A. Create an account and register you as a new customer, as well as verify whether you already have an account on the “Site” and/or “Mobile Application.”
B. Process and deliver your order, including: recording the details of your order; keeping you informed about the status of the order placed and confirming its receipt.
C. Protect you, ourselves, the “Site,” and/or the “Mobile Application” against fraud and theft.
D. Manage our relationship with you, including: providing the information, products, and services you request; notifying you of changes to our services, Terms and Conditions, or Policies; and requesting that you leave a review or participate in surveys.

J. Process your payments in accordance with the provisions set forth in sections 2 and 4, subsection C of this Policy.
K. Fulfill our obligations and enforce our rights arising from any contract entered into between you and HEREA, including all billing and collection processes.

PROCESSING OF YOUR PERSONAL DATA WITH THIRD PARTIES

In accordance with the provisions of Articles 35 and 36 of the Federal Law on the Protection of Personal Data Held by Private Parties, your personal data will be made available and may be accessed, in addition to HEREA, only by those individuals and/or entities that require such information to fulfill the purposes of the intended processing, such as:

A. Affiliated organizations:

Includes any member of our economic interest group and/or subsidiaries and/or the controlling company, as well as their respective affiliates.

B. Service providers:

Includes third parties contracted for the outsourcing of operations, such as advertising service providers, payment processors, data analytics companies, logistics fulfillment companies, customer service specialists, email delivery service providers, auditing firms and professional services, technology infrastructure providers and related services, web hosting companies, and customer relationship management system providers, among other third parties with whom we maintain contractual relationships.

C. Corporate transfers:

Includes situations in which HEREA or our affiliates are acquired, merged, or receive investment from another company; or in the event that any of our assets are transferred to another entity, whether as part of a dissolution, reorganization, bankruptcy, insolvency, or other similar proceeding. In such cases, we may disclose or transfer personal information to a potential or actual buyer, or to any relevant third party, such as agents and advisors, among others.

D. Competent authorities:

Includes government agencies and judicial authorities, in cases where we are required to comply with applicable laws, regulations, or standards, requests from competent, regulatory, or other governmental authorities, or in compliance with binding legal processes, such as subpoenas, court orders, to enforce our legal rights, or to protect you, ourselves, or third parties from damages."

TRASNFER AND PROCESSING OF YOUR INFORMATION

In accordance with the provisions of Article 36 of the Federal Law on the Protection of Personal Data Held by Private Parties, you should be aware that your personal information may be transferred and stored on servers or databases located outside your state, municipality and/or province or country of residence.

THIRD-PARTY SITES

You acknowledge and accept that any link we provide to third-party websites or services is offered solely for your convenience and information, and therefore you acknowledge and accept that HEREA is not the owner, operator, and is in no way responsible for the content, operation, or management of such third-party sites and/or services. Accordingly, this Policy does not apply to platforms not affiliated with HEREA.

Likewise, you acknowledge and accept that if you access third-party websites and/or services through the links provided, you will review the corresponding privacy policies. Therefore, by this act, you acknowledge and confirm that HEREA assumes no responsibility for the content of non-affiliated sites, for your use of such sites or services, nor for the privacy practices of third parties.

YOUR PRIVACY RIGHTS

You have the right to access the personal information you have provided to us, as well as to exercise the ARCO RIGHTS contemplated in the Federal Law on the Protection of Personal Data Held by Private Parties, namely, the rights of access, rectification, cancellation, and opposition to the processing of personal data, in accordance with the provisions established in Chapter IV of the aforementioned Law.

By virtue of the foregoing, you shall have and may exercise at any time the following rights:

A. Right of Access: You shall have the right to access the personal data collected by HEREA, as well as to be informed about the conditions and general aspects of the processing that HEREA will carry out with such data. To learn more about this, you should consult our Privacy Notice.

B. Right of Rectification: You shall have the right to request the rectification or correction of the personal data collected by HEREA, when such data proves to be inaccurate, incomplete, or outdated.

C. Right of Cancellation: You shall have the right to request the cancellation of the personal data collected by HEREA from files, records, as well as from the HEREA “Site” and/or Mobile Application, so that such data may be deleted and HEREA refrains from using and/or retaining it in the databases of the “Site” and/or Mobile Application.

D. Right of Objection: You shall have the right at all times to object to the processing and/or use of the personal data collected by HEREA, as well as to request its cessation. Likewise, the user acknowledges and confirms that they may not exercise the right of objection in those cases where the processing and/or collection of personal data is necessary to comply with an obligation imposed by a competent judicial and/or administrative authority.

MODIFICATIONS

You acknowledge and confirm that HEREA will update and/or modify this Privacy Policy in order to reflect changes in our practices, or for operational, legal, and/or regulatory reasons. When any modification is made, the revised version of this Privacy Policy will be published on the “Site” and/or Mobile Application. Therefore, we recommend that you review this Privacy Policy regularly, as it shall take effect on the same day it is published.
