In accordance with the provisions of Articles 2, Section I, 14, 15, 16, 17, 18 and other related articles of the Federal Law on Protection of Personal Data Held by Private Parties; HEREA RETAIL, S.A. DE C.V., with registered address at Paseo de la Espuela 306, Residencial La Hacienda, Torreón, Coahuila, C.P. 27276, Mexico, is responsible for the use and protection of the user's personal data.

For further information, the user may consult HEREA’s website, as well as its Privacy Policy. Additionally, the following is hereby informed:

The information collected will be used to process orders as well as to deliver the products and services requested through HEREA’s Website and/or Mobile Application, in order to provide better service.

The collection and processing of Personal Data allows us to provide a more efficient service for the execution of operations in a fast and secure manner.

HEREA will use personal information for the use and access to the platform referred to, as well as for the following purposes:

• Website users
• Commercial information
• Promotions
• Marketing or advertising
• Commercial prospecting

In order to carry out the purposes described in this privacy notice, the following data will be used:

• Identification data
• Contact data
• Bank account data
• Payment information and methods

The user has the right to know what personal data HEREA has collected, what it will be used for, and the conditions under which such data is used (Access). Likewise, the user has the right to request the correction of the personal information provided in case it is outdated, inaccurate, or incomplete (Rectification); to request that such information be deleted from HEREA’s records or databases when the user considers that it is not being used appropriately (Cancellation); and may also oppose to the use of their personal data for specific purposes (opposition). The rights described above are known as ARCO rights.

The user may request from HEREA, at any time, Access, Rectification, Cancellation, or Opposition to the consent granted for the use of the personal data provided, by submitting a request via email to privacy@herea.com or by calling +52 (871)-169-5997. Likewise, to request more information regarding ARCO Rights, as well as to exercise them and to object to their personal data being shared with third parties for direct marketing purposes, the user may contact us at +52 (871)-169-5997. At any time, you may revoke the consent that you may have granted to HEREA for the processing of your personal data. However, it is important to note that your request may not be fulfilled or the use of the personal data provided may not be immediately terminated in all cases, as it is possible that, due to a legal obligation or reason, it may be necessary to continue using such data. Likewise, the user should consider that, for certain purposes, the revocation of their consent may result in the inability to continue providing the requested service or product, or, as the case may be, the termination of their relationship with HEREA.

To revoke their consent, the user must submit their request by sending an email to privacy@herea.com. 

The user may limit the use and disclosure of their personal information by submitting their request via email to privacy@herea.com. 

Now then, you accept and acknowledge that, in accordance with the provisions of Articles 35 and 36 of the Federal Law on Protection of Personal Data Held by Private Parties, your personal data will be available and may be accessed not only by HEREA but also by those persons and/or entities that require such information in order to fulfill the purposes of the intended processing, as well as in the following cases:

A.        To identify, locate, or take legal action against those individuals who violate the conditions of service of the platform, cause damage, or interfere with said platform or with the rights of HEREA, its properties, those of other users of the platform, or of any person who may be harmed by such actions.

B.        For the purposes indicated in the Privacy Policy.

C.        To service providers when they are contracted by HEREA to act on its behalf to provide specific services following our instructions, for the purpose of contributing to the improvement or facilitation of operations that must be carried out through the platform, which may include:

•  Courier and parcel delivery companies.
•  Payment methods, intermediaries in payment processing or insurance.
•  Government entities or companies specialized in risk assessment, for the purpose of verifying the information provided.

Service providers will access the Personal Data provided solely and exclusively for the purpose of delivering the requested services and may not use such data for any purposes other than those established with HEREA.

D.        HEREA will not share confidential information with third parties, except with your express authorization or when such information is requested by a duly grounded and reasoned court order or legal mandate issued by a competent authority.

If the user does not wish for their data to be shared, they may opt out of a specific service or refrain from participating in certain promotions or activities.
Personal Data will be stored for as long as necessary to provide the requested services.

You accept and acknowledge that Cookies, web beacons, or other technologies are used on the Site and/or Mobile Application, through which it is possible to monitor your behavior as an internet user, as well as to provide you with better service and experience when browsing the website. The personal data collected through these technologies will be used for the following purposes:

• Commercial information.
• Promotions.
• Commercial prospecting.
• As well as those established in the Cookies Policy.

The data obtained from these technologies are:

•  Identifiers, username, and passwords of a session.
•  Region in which the user is located.
•  User's browser type.
•  Date and time of the beginning and end of a user's session.

You declare and acknowledge that HEREA shall not be held responsible in the event of illegal interceptions or violations of its systems or databases, or for their use by unauthorized persons.
This Privacy Notice shall be governed by the applicable provisions of current Mexican laws. In the event of any dispute arising, it shall be submitted to the jurisdiction of the Competent Courts of the State of Coahuila, expressly waiving any other jurisdiction that may correspond due to present or future domicile or for any other reason.

This privacy notice may undergo modifications, changes, or updates resulting from new legal requirements; from the needs related to the services or products offered to you by HEREA; from the company’s privacy practices; changes in the business model; or other causes. Any change will be made known to the user through the Site and/or Mobile Application and will take effect on the same day of its publication.

Finally, once this Privacy Notice has been read, you declare and consent that your personal data may be processed in accordance with the terms and conditions set forth in this privacy notice.
